The Thai Senate has Approved a Historic Bill to Legalize Marriage Equality in Thailand

Bangkok — Thailand’s Senate has voted decisively to approve a bill legalizing same-sex marriage, positioning Thailand to become the first country in Southeast Asia to enact such a law. This landmark decision reflects Thailand’s reputation for acceptance and inclusivity, even as the nation has struggled for decades to pass marriage equality legislation.

Historically, Thai society has been known for its conservative values, and the LGBTQ+ community frequently faces everyday discrimination. Moreover, conservative government and state agencies have also posed significant challenges to advocates for gender equality, who have worked tirelessly to push for legislative change.

With the new law, Thailand will join Taiwan and Nepal as the third country in Asia to allow same-sex marriage. The marriage equality bill, which grants full legal, financial, and medical rights to marriage partners of any gender, passed through the House of Representatives in April with overwhelming support—400 out of 415 members in favor. In its final reading, the Senate approved the bill with a vote of 130 out of 152 members, with 4 against and 18 abstaining.

Currently, the bill awaits the formal endorsement of King Maha Vajiralongkorn and its publication in the Government Gazette, which will set a date for the law to become effective within 120 days. However, the bill faced opposition from some, including retired army General Worapong Sa-nganet, who argued for retaining gender-specific terms to avoid “subversion of the institution of family” in Thailand.

Following the vote, Plaifah Kyoka Shodladd, an 18-year-old non-binary individual, expressed gratitude to the supporters of the legislation, calling it a “force of hope” that will help Thailand become more accepting of diversity. “Today, love trumps prejudice,” Plaifah said.

The Thai government, confident in the bill’s passage, celebrated the occasion at Government House with rainbow decorations and a parade featuring politicians, celebrities, diplomats, and LGBTQ+ activists. Prime Minister Srettha Thavisin, who was unable to attend due to a positive COVID-19 test, congratulated the nation via social media, emphasizing the importance of unity in diversity.
